Purchase and Return

  1. General Provisions.
    1.1. These Rules of Purchase and Sale of Goods (hereinafter referred to as the Rules) are a legal document binding on the Parties, which establishes the rights, obligations and responsibilities of the Buyer and the Seller when the Buyer purchases goods in the e-shop sominta.com.
    1.2. The Seller hereby reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements established by law. The Buyer shall be informed about the changes on the website of the e-shop sominta.com. When the Buyer makes a purchase in the e-shop sominta.com, the applicable Rules shall be valid at the time of placing the order.
    1.3. The following persons shall have the right to buy handbags in the e-shop sominta.com:
    1.3.1. able-bodied natural persons, i.e. persons of legal age and whose capacity is not restricted by court order;
    1.3.2. minors between the ages of 14 and 18, only with the consent of their parents or guardians, except in cases where they have their own income;
    1.3.3. legal entities;
    1.3.4. authorised representatives of all the abovementioned persons.
    1.4. By approving the Rules, the Seller shall also guarantee that, in accordance with Clause 1.3. of the Rules, the Buyer shall have the right to purchase goods (handbags) in the e-shop sominta.com.
    1.5. The agreement between the Buyer and the Seller shall be considered concluded from the moment when the Buyer in the e-shop sominta.com clicks the „Confirm Order” button after creating a shopping cart, indicating the delivery address, choosing the payment method and getting acquainted with the Seller’s Rules (see Clause 5 „Ordering of Goods, Prices, Payment Procedure, Terms”).
    1.6. Each agreement concluded between the Buyer and the Seller shall be stored in the e-shop sominta.com.
  2. 2. Protection of Personal Data.
    2.1. When ordering goods, the Buyer must indicate in the relevant information fields provided by the Seller the personal data of the Buyer necessary for the proper execution of the order: name, surname, delivery address, telephone number and e-mail address. The received data shall be used only for invoicing and sending the consignment. Data shall be stored in accordance with the laws in force in Lithuania.
    2.2. By approving these Rules, the Buyer hereby agrees that the Buyer’s personal data provided in Clause 2.1. shall be processed for the purposes of sales of goods and services in the e-shop sominta.com, analysis of the Seller’s activities and direct marketing.
    2.3. By agreeing that the Buyer’s personal data shall be processed for the purpose of selling goods and services in the Seller’s e-shop sominta.com, the Buyer also agrees that the information messages necessary for the execution of the order of goods shall be sent to the e-mail address and telephone number provided by the Buyer.
  3. 3. Rights and Obligations of the Buyer.
    3.1. The Buyer shall have the right to withdraw from the purchase and sale agreement with the e-shop sominta.com by notifying the Seller thereof in writing (by e-mail, indicating the product to be returned and its order number) no later than within 14 (fourteen) business days from the item (handbag) delivery date.
    3.2. The Buyer may exercise the right provided for in Clause 3.1. of the Rules only if the product has not been damaged or its appearance has not substantially changed, also if it has not been used.
    3.3. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.
    3.4. If the data provided in the Buyer’s registration form changes, the Buyer must update them immediately.
    3.5. The Buyer undertakes not to pass on its login details to third parties. If the Buyer loses the login data, it must immediately inform the Seller thereof by the means of communication specified in the section „Contacts„.
    3.6. By using the e-shop sominta.com, the Buyer hereby agrees with these Purchase and Sale Rules and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.
  4. 4. Rights and Obligations of the Seller.
    4.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the e-shop sominta.com.
    4.2. The Seller undertakes to respect the Buyer’s right to privacy of the Buyer’s personal information specified in the e-shop registration form.
    4.3. The Seller undertakes to deliver the goods (handbags) ordered by the Buyer to the address specified by the Buyer.
  5. 5. Ordering of Goods, Prices, Payment Procedure, Terms.
    5.1. In the e-shop sominta.com, the Buyer may buy handbags 24 hours a day, 7 days a week.
    5.2. The agreement shall take effect from the moment the Buyer clicks the „Confirm Order” button.
    5.3. The prices of the goods in the e-shop sominta.com and in the formed order shall be indicated in euros, including VAT.
    5.4. The Buyer shall pay for the goods using electronic banking – this shall be a prepayment using the electronic banking system used by the Buyer.
    5.5 All payments shall be made through Paysera or PayPal, which meet all the strictest security requirements, therefore, you will not have any problems with payment and will not have to question the security of your data.
    5.6. The Buyer undertakes to pay for the goods immediately. The consignment of goods shall begin to be formed and the term for delivery of goods shall begin to count only upon receipt of payment for the goods.
  6. 6. Delivery of Goods.
    6.1. The Buyer, having chosen the delivery service at the time of ordering, undertakes to indicate the exact place of delivery of the goods.
    6.2. Delivery shall take place by post or courier service.
    6.3. The delivery price shall be calculated and indicated by filling in the delivery address of the goods.
    6.4. The Seller shall deliver the goods to the Buyer within 2-30 business days, depending on the chosen delivery method and country. These terms are preliminary and shall not apply in cases when the Seller does not have the required goods in stock and the Buyer is informed about the shortage of the ordered goods. At the same time, the Buyer hereby agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances or circumstances beyond the control of the Seller. In such a case, the Seller undertakes to immediately contact the Buyer and agree on the terms of delivery of the goods.
    6.5. In all cases, the Seller shall be released from liability for violation of the terms of delivery of goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Seller’s control.
    6.6. The Buyer must in all cases immediately inform the Seller if the consignment is presented in crushed or otherwise damaged packaging, if the consignment contains unsolicited goods or goods of incorrect quantity as well as incomplete goods.
  7. 7. Quality of Goods, Warranties.
    7.1. The details of each product sold in the e-shop shal be indicated in the product description.
    7.2. The Seller shall not be liable for the fact that the goods in the e-shop may not correspond in colour, shape or other parameters to the actual size, shape and colour of the goods due to the characteristics of the monitor used by the Buyer.
  8. 8. Return and Replacement of Goods.
    8.1. Defects of sold goods shall be eliminated, low-quality goods shall be replaced or returned in accordance with the Rules of Return and Exchange of Goods approved by Order of the Minister of Economy of the Republic of Lithuania of 29 June 2001 No. 217 “On Approval of the Rules for Return and Exchange of Items”. In all cases, the money for the returned goods shall be transferred only to the payer’s bank account.
    8.2. In order to return the product (s) in accordance with Clause 8.1. of the Rules, the Buyer may do so within 14 (fourteen) business days from the date of delivery of the goods to the Buyer by informing the Seller by the means of communication specified in the contact section, indicating the name of the returned goods, the order number and the reasons for the return.
    8.3. When the Buyer returns the goods, the following conditions must be met:
    8.3.1. the returned goods must be in the original neat packaging;
    8.3.2. the goods must be undamaged by the Buyer;
    8.3.3. the product must be unused, must not have lost its commercial appearance (labels must be undamaged, protective film must not be peeled off, etc.) This Clause shall not apply in case of return of defective product;
    8.3.4. the returned product must be in the same configuration as the Buyer received it;
    8.3.5. when returning the goods, it shall be necessary to present the document of its acquisition.
    8.4. The Seller shall have the right not to accept the goods returned by the Buyer if the Buyer does not follow the procedure for returning the goods set out in Clause 8.3.
  9. 9. Liability of the Buyer and Seller.
    9.1. The Buyer shall be fully liable for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the registration form, the Seller shall not be liable for the consequences and shall acquire the right to claim compensation for direct losses incurred by the Buyer.
  10. 10. Marketing and Information.
    10.1. The Seller may, at its discretion, initiate various promotions in the e-shop.
    10.2. The Seller shall have the right to unilaterally, without separate notice, change the terms of the promotions, as well as cancel them. Any change in the terms and conditions of the promotions shall be valid from the moment of their announcement until the moment of suspension/cancellation, unless otherwise stated in the terms and conditions of the promotion.
    10.3. The Seller shall send all notices by the means of communication specified in the Buyer’s registration form.
    10.4. The Buyer shall send all notices and questions to the telephone numbers and e-mail addresses specified in the “Contacts” section of the Seller’s e-shop.
    10.5. The Seller shall not be liable if the Buyer does not receive the sent information or confirmation messages due to internet network, e-mail service provider network failures.
  11. 11. Final Provisions.
    11.1. These Rules of Purchase and Sale of Goods have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
    11.2. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If no agreement can be reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
